Poll

April 24th, 2008 (12:50 pm)

This whole 'Can I Touch Your Boobs' thing has me thinking.

Say that a women who participated in this grope-fest got gang-raped that night in some quiet stairwell.

Say that the guys all claimed it was consensual and it boiled down to her word against theirs.

Say that they could honestly state that just hours earlier she approached them, in public, and invited them to fondle her breasts.

What do you think would happen?

It's almost impossible to successfully prosecute gang rape, no matter the circumstances, because it's their word against hers, and there are more of them saying it was consensual.

Actually, a footballer got off on a rape charge this week because the judge said she was too drunk to have NOT given consent. Basically, she asked for it by being really drunk. Another example of why less than 8% of rapes taken to court are successfully prosecuted.

Wait, so if she were drugged and raped, she was asking for it because she was too high to say no? Yeah, that's why CA has laws saying that if someone says no at ANY time, it's rape and if consent is under question like if they are drunk or just intoxicated, they can prosecute for rape. I don't care if some people think it's over the top, I'm damn glad those laws are there.

"No" should be the assumed DEFAULT, not yes. That's just sick and disgusting and sad in so many ways. Rape is not a punishment for drinking too much.

No other witness as to whether or not she said no than her rapist. The fact she was intoxicated, sadly, means in this judges eye that she was asking for it, not that she was unable to give consent. Absolutely disgusting. BUT, you have to remember, her rapist in this case was a footballer, and therefore under Australian law this makes him free to pretty much do whatever he wants. Other than to king hit another footballer. Sacrosanct arseholes.

Exactly. And being able to produce witnesses regarding that grope-fest would (in my opinion) make 'almost impossible' into 'completely impossible'.

Nobody asks to be raped, not by getting drunk or stoned or carried away by the atmosphere at a con and going along with crap like this.

But when judges can say a woman 'asked for it' just for the clothes she wore - it's too easy to see how this situation would go down.

Something like this has happened to my nephews girlfriend just three months ago. She's 17 and went to a party at a friends house. Someone had slipped her the "date" drug and proceeded to pass her around to those who wanted to have fun.

She went to the hospital and reported the incident to the police. The sad thing of this is that its not going to go to court because she dose not remember who did it to her. Just DNA evidence is on file, but without knowing its kinda pointless.

I feel really bad for her, she tried to commit suicide and isn't coping at all.

Poor thing. It's so bad that girls need to travel in packs and swear to look out for each other, even when going to venues that should be safe..

Sadly a lot of the girls of that age group that I know will get drunk and high so casually - not even realising the potential dire consequences until it's too late.

For the most part though we have to make sure we don't put ourselves in a position to be at risk. Which is why the dumb post that sparks this has so many people angry, I guess.

My sympathies to your nephew's girlfriend.

The police would probably think she asked for it. That's how our society still works.

But, my dear [info]ligia_elena came up with the alternative project :) *point to icon*
